கேள்விகள்:

TET கட்டாயமாக்கப்படுவதற்கு முன்பே பணியில் சேர்ந்த ஆசிரியர்களுக்கு (கர்நாடகா உட்பட) இந்த விதியால் ஏற்பட்டுள்ள தாக்கத்தை அரசு ஆய்வு செய்துள்ளதா?

நாட்டில் அத்தகைய ஆசிரியர்களின் எண்ணிக்கை எவ்வளவு?

TET அமலுக்கு வரும் முன் நியமிக்கப்பட்ட ஆசிரியர்களுக்கு விலக்கு அளிக்கும் வகையில் இலவச கட்டாயக் கல்வி உரிமைச் சட்டத்தில் (RTE Act, Section 23) திருத்தம் செய்யப்படுமா?

இந்த ஆசிரியர்கள் குறித்த காலத்திற்குள் TET தேர்ச்சி பெற அரசு என்ன நடவடிக்கை எடுத்துள்ளது?

அவர்களுக்கு ஏதேனும் தற்காலிக விலக்கு/ஆறுதல் (Transitional relief) அளிக்கும் திட்டம் உள்ளதா?

2. மத்திய அரசு அளித்த பதில்

மாநிலங்களின் அதிகாரம்:

கல்வி என்பது பொதுப்பட்டியலில் (Concurrent List) உள்ளது. எனவே ஆசிரியர்கள் நியமனம், அவர்களின் சேவை விதிகள் மற்றும் TET கட்டாயமாவதற்கு முன் பணியில் சேர்ந்த ஆசிரியர்கள் பற்றிய விவரங்கள் அந்தந்த மாநில மற்றும் யூனியன் பிரதேச அரசுகளின் கட்டுப்பாட்டிலேயே வருகின்றன.

உச்ச நீதிமன்ற தீர்ப்பு:

உச்ச நீதிமன்றத்தின் தீர்ப்பின்படி (01.09.2025), இலவச கட்டாயக் கல்வி உரிமைச் சட்டத்தின்படி (RTE Act, 2009) பள்ளிகளில் ஆசிரியராகப் பணியாற்ற TET தேர்வு என்பது கட்டாயமான குறைந்தபட்சத் தகுதியாகும்.

கால அவகாசம் நீட்டிப்பு:

உச்ச நீதிமன்றம் தனது மறுஆய்வு மனுக்களின் மீதான தீர்ப்பில் (29.05.2026), ஆசிரியர்கள் TET தகுதியைப் பெறுவதற்கான கால அவகாசத்தை 31.08.2027-லிருந்து 31.08.2028 வரை நீட்டித்துள்ளது.

ஆண்டிற்கு 2 முறை TET தேர்வு:

ஆசிரியர்கள் இந்த குறைந்தபட்சத் தகுதியைப் பெற ஏதுவாக, சம்பந்தப்பட்ட அரசுகள் ஆண்டிற்கு இரண்டு முறை (சுமார் 6 மாத இடைவெளியில்) தவறாமல் TET தேர்வுகளை நடத்த வேண்டும் என்றும் உச்ச நீதிமன்றம் அறிவுறுத்தியுள்ளது.

💡 சுருக்கமாக:

முக்கியச் செய்தி: TET கட்டாயமாவதற்கு முன் பணியில் சேர்ந்த ஆசிரியர்களும் TET தேர்ச்சி பெறுவது கட்டாயம் என்பதில் உச்ச நீதிமன்றம் உறுதியாக உள்ளது. ஆனால், அவர்கள் தேர்ச்சி பெறுவதற்கான கால அவகாசம் 31 ஆகஸ்ட் 2028 வரை நீட்டிக்கப்பட்டுள்ளது. மேலும், இதற்காக மாநில அரசுகள் ஆண்டிற்கு 2 முறை TET தேர்வை நடத்த வேண்டும் என அறிவுறுத்தப்பட்டுள்ளது.


மத்திய அரசு அளித்துள்ள பதிலில் இருந்து நாம் புரிந்துகொள்ள வேண்டியது இதுதான்:

 * சட்டத் திருத்தம் இல்லை: கல்வி உரிமைச் சட்டப் பிரிவு 23-ல் (Section 23) திருத்தம் கொண்டுவந்து, பழைய ஆசிரியர்களுக்கு TET தேர்வில் இருந்து விலக்கு அளிக்கும் எண்ணம் மத்திய அரசிடம் இல்லை.

 * உச்ச நீதிமன்றத் தீர்ப்பே இறுதியானது: உச்ச நீதிமன்றம் TET தேர்வைக் கட்டாயமாக்கித் தீர்ப்பளித்துள்ளதால், சட்டத்தை மாற்றுவதற்குப் பதிலாக நீதிமன்றத் தீர்ப்பையே அரசு பின்பற்றுகிறது.

 * விலக்கு அல்ல, கால அவகாசம் மட்டுமே: ஆசிரியர்களுக்கு விலக்கு அளிப்பதற்குப் பதிலாக, அவர்கள் TET தேர்ச்சி பெற 31 ஆகஸ்ட் 2028 வரை கால அவகாசத்தை நீட்டிப்பது மற்றும் ஆண்டிற்கு இரண்டு முறை தேர்வு நடத்துவது மட்டுமே தற்போதைய தீர்வாக முன்வைக்கப்பட்டுள்ளது.

சுருக்கமாகச் சொன்னால், TET தேர்வில் இருந்து யாருக்கும் விலக்கு அளிக்கப்படாது; ஆனால் தேர்ச்சி பெற கூடுதல் அவகாசம் வழங்கப்பட்டுள்ளது.

Impact of Teacher Eligibility Test

212. Shri E Tukaram:

Will the Minister of EDUCATION be pleased to state:

(a) whether the Central Government has assessed the impact of the Teacher Eligibility Test (TET) requirement on in-service teachers in the country including Karnataka who were  appointed before the TET was made mandatory;

(b) if so, the number of such teachers in the country, State/UT-wise including Karnataka;

(c) whether the Central Government proposes to amend Section 23 of the Right of Children  to Free and Compulsory Education Act, 2009, to provide appropriate relief to teachers  appointed before the TET requirement came into force, if so, the details thereof; and

(d) the steps taken or proposed by the Central Government to help such teachers qualify the TET before the prescribed deadline, including ensuring that TET examinations are conducted regularly; and

(e) whether any transitional relief is under consideration and if so, the details thereof?

(a) to (e): Education is a subject in the Concurrent List of the Constitution and the  recruitment, service conditions and deployment of teachers fall within the administrative  domain of the respective State Governments and Union Territory Administrations. 

Accordingly, the data regarding the number of in-service teachers, including those in the State of Karnataka, who were appointed prior to the introduction of the mandatory Teacher Eligibility Test (TET), is maintained by the respective State Governments and Union Territory Administrations.

The Hon'ble Supreme Court of India, vide its judgment dated 01.09.2025, inter alia, held that the Teacher Eligibility Test (TET) is one of the minimum qualifications prescribed under  Section 23 of the Right of Children to Free and Compulsory Education (RTE) Act, 2009, and is mandatory for appointment as a teacher in schools covered under the Act. Subsequently, while disposing of the review petitions in the matter, vide judgment dated  29.05.2026 the Hon'ble Supreme Court extended the timeline for acquisition of TET  qualification from 31.08.2027 to 31.08.2028. The Hon'ble Supreme Court, in the judgment dated 29.05.2026, has further observed that the  respective appropriate Governments/authorities should endeavour to conduct the Teacher  Eligibility Test (TET) periodically, preferably twice every year, with an interval of  approximately six months between successive examinations, so as to afford eligible teachers a reasonable opportunity to comply with the prescribed minimum qualification.
