Government Ordinance G.O.Ms.No.103, Dated: 18-06-2024 Issued to increase the amount of compensation to be paid to the heirs of polling personnel who are died / injured during local body election work...


ABSTRACT
Elections - Ordinary Elections to Local Bodies / Casual Elections to Local Bodies.Payment of ex-gratia compensation to the polling personnel / legal heirs of polling personnel who die or sustain injuries while on election duty - Revised slabs.Sanctioned - Orders - Issued.

ORDER.
In the Government Order first read above, orders have been issued providing for the payment of ex-gratia compensation amount to the polling personnel/legal heirs of polling personnel who die or sustain injuries while on election duty the Ordinary Elections to Local Bodies, 2011 and future Ordinary / Casual Elections to Local Bodies be made as detailed below:-

1. Rs.5,00,000/-(Rupees five lakhs only) in case of death.

2. Rs.10,00,000/-(Rupees ten lakhs only) in case of death caused due to any violent acts of extremist or unsocial elements like road mines,bomb blasts, armed attacks etc.

3. Rs.2,50,000/- (Rupees two lakhs and fifty thousand only) in case of permanent disability like loss of limb, eye sight etc.

4. The above amount shall be paid in double, i.e. Rs.5,00,000/-(Rupees five lakhs only) in case of such mishaps being caused by extremists or unsocial elements.

5. Rs.10,000/-(Rupees ten thousand only) in case of minor injury.



(ii)
. The Secretary, Tamil Nadu State Election Commission has further requested that the following clause may also be incorporated while issuing the orders in this regard.
"The payment will cover any mishap occurred during the entire period of election duty connected with polling. A person is to be treated on election duty as soon as he leaves his residence / office to report for any election related duty including training and until he reaches back his residence / office after performance of his election related duty. If any mishap takes place during this period, it should be treated as having occurred on election duty subject to condition that there should be a casual connection between occurrence of death / injury and the election duty"

6. After careful examination the Government have decided to accept the proposal of the Secretary, Tamil Nadu State Election Commission and accordingly the Government order that the payment of ex-gratia compensation to the polling personnel/legal heirs of polling personnel who die or sustain injuries while on election duty during the Ordinary Elections to Local Bodies, 2024 and future Ordinary Elections to Local Bodies / Casual Elections to Local Bodies as details below:-


(i) An amount of Rs.15 Lakhs as the minimum amount to be paid to the next of kin of the official in the unfortunate event of death of the official while on election duty.
(ii) If the death is unfortunately caused due to any violent acts of extremist or unsocial elements like road mines, bomb blasts, armed attacks, etc., the amount of compensation would be Rs.30 Lakhs.
(iii) In case of permanent disability, like loss of limb, eye sight, etc., a minimum ex-gratia payment of Rs.7.5 Lakhs would be given to the official(which would be doubled in the case of such mishaps being caused by extremist or unsocial elements as aforesaid).
(iv) Rs.40,000/- in case of minor injury.

7. The Government also order that the payment will cover any mishap occurred during the entire period of election duty connected with polling. A person is to be treated on election duty as soon as he leaves his residence I office to report for any election related duty including training and until he reaches back his residence / office after performance of his election related duty. If any mishap takes place during this period, it should be treated as having occurred on election duty subject to condition that there should be a casual connection between occurrence of death / injury and the election duty.


8. The expenditure shall be debitable to the following head of account to which the expenditure on Local Body Elections is booked:-

2015-00 ELECTIONS - 109 Charges for conduct of election to Panchayats /Local Bodies - State's Expenditure -AA. Elections to Panchayats -351. Compensation -02. Other Compensation.
(DPC 2015-00-109-AA-35102).


This order is issued with the concurrence of Finance Department vide its U.O. No.118/Fin(RD)/2024, Dated 12.06.2024.
