அரசு வழங்க முடியாது என எதிர் மனு தாக்கல்
* தகுதி மதிப்பெண்களைத் தீர்மானிப்பது அரசின் கொள்கை சார்ந்த மற்றும் வல்லுநர் குழு சார்ந்த விடயமாகும். தேர்வு முடிந்த பிறகு தகுதி மதிப்பெண்களைக் குறைப்பது தேர்வின் நம்பகத்தன்மையையும் கல்வித் தரத்தையும் பாதிக்கும்
* உச்ச நீதிமன்றம் தனது தீர்ப்பில் TET தேர்வை கட்டாயத் தகுதியாகவே உறுதி செய்துள்ளது. பணியில் உள்ள ஆசிரியர்களுக்குத் தேர்ச்சி பெற கால அவகாசம் மட்டுமே நீட்டிக்கப்பட்டுள்ளதே தவிர, தகுதி மதிப்பெண்களில் எந்த இளகும் (relaxation) வழங்கப்படவில்லை
* மத்திய அரசின் இலவச மற்றும் கட்டாயக் கல்வி உரிமைச் சட்டம், 2009 (RTE Act) பிரிவு 23-ன் கீழ், ஆசிரியர் தகுதித் தேர்வு (TET) ஒரு கட்டாய சட்டப்பூர்வ தகுதியாகும். இடஒதுக்கீடு பிரிவினருக்கு (SC/ST/OBC/மாற்றுத்திறனாளிகள்) சலுகை வழங்குவது மாநில அரசின் அதிகாரத்திற்கு உட்பட்டது; ஆனால் பொதுப் பிரிவினருக்கு தகுதி மதிப்பெண்ணைக் குறைக்க NCTE விதிகளில் இடமில்லை.
* 08.07.2026 அன்று அளிக்கப்பட்ட இடைக்காலத் தடையை (Interim Order) நீக்கி, இந்த வழக்கை தள்ளுபடி செய்ய வேண்டும் என்று அரசால் நீதிமன்றத்திடம் கோரப்பட்டுள்ளது

PRAYER IN WP(MD) No.3374 of 2021:
To issue a Writ of Certiorarified Mandamus calling for the records relating to the impugned order issued by the 2nd respondent in his proceedings in ந.க.எண்:.43107/சி1/இ1/2020 dated 15.02.2021 so far as the inclusionof the promoted P.G.Assistants in the panel list for appointment to the post of High School Headmaster are concerned and quash the same as illegal and consequently to direct the respondents to prepare the panel list for promotion to the post of High School Headmaster by strictly following the service Rules.
7. This Court is able to visualise the prejudice that could be caused to the senior teachers, who are awaiting the general transfer counseling and such transfer-postings may become redundant owing to the possibility of junior teachers being posted in the place of their choice through promotion counseling. No prejudice would be caused to the Department, if the promotion counseling is postponed by a few days and during which period, the possibility of holding transfer counseling can be explored.
8.In this background, there shall be an order of interim injunction till 24.02.2021.
9.The learned Special Government Pleader is called upon to explore feasibility to hold the transfer counseling prior to the promotion counseling.
