அமைச்சுப் பணியாளர்கள் ஆசிரியர் தகுதி தேர்வில் தேர்ச்சி பெற்றிருந்தாலும் நேரடியாக 2% பதவி உயர்வை அடைய முடியாது
அமைச்சுப் பணியாளர்களின் இரண்டு சதவீத பதவி உயர்வு வழக்கில் இனிமேல் எந்த ஒரு அமைச்சுப் பணியாளரும் ஆசிரியர் தகுதி தேர்வு தாள் இரண்டில் தேர்ச்சி பெற்றிருந்தாலும் நேரடியாக BT அல்லது PG ஆக பதவி உயர்வு அடைய முடியாது .
மாறாக அவர்கள் ஆசிரியர் தகுதி தேர்வு தாள் இரண்டில் தேர்ச்சி பெற்ற பிறகு நியமன தேர்விலும் தேர்ச்சி பெற்றால் மட்டுமே அவர்களுக்கு பதவி உயர்வு அளிக்க முடியும் என்று நீதிமன்றத்தில் தமிழ்நாடு அரசு பதில் மனு தாக்கல் செய்துள்ளது .
மேலும் அதற்கான திருத்தங்களை விதிகளில் மேற்கொண்டு வருவதாகவும் குறிப்பிட்டுள்ளது .
இது சார்ந்து விரைவில் அரசாணை வெளியிடப்படும் என்பது இதன் மூலம் தெளிவாக புலனாகிறது .
It is respectfully submitted that as observed above by the Hon'ble Division Bench of Madras High Court, the Government has deemed it fit and proposed to conduct a competitive examination for the eligible ministerial staff under 2% reservation among themselves, so as to enable them for being promoted as BT Assistants in order to ensure the academic excellence of the students in the Government Schools. Hence, for the above said purpose, the Special Rules for the Tamil Nadu School Educational Subordinate Service, need to be amended suitably. For the completion of the said amendment process, some more time is required.
Under these circumstances it is therefore most humbly prayed that this Hon'ble Court may be pleased to accept the Affidavit filed by the respondents and grant 3 (Three) months' time for making suitable amendments to the Special Rules for the Tamil Nadu School Educational Subordinate Service, and pass such other orders as this Hon'ble court deems fit in the circumstances of the case and thus render justice.
