மேல்முறையீட்டாளர் தானும் தனது குடும்ப உறுப்பினர்களும் எந்த சாதி அல்லது மதத்தையும் சேர்ந்தவர்கள் அல்ல என்று அரசாங்கத்தால் சான்றளிக்கப்பட்டுள்ளனர் என்ற கூற்று பாராட்டத்தக்கது என்றும், இது நீண்ட காலத்திற்கு, சாதி அடிப்படையிலான பாகுபாட்டைத் தடை செய்வதை ஊக்குவிக்கும் என்றும், ஒத்த எண்ணம் கொண்ட குடிமக்களுக்கு ஒரு கண் திறப்பாகவும் இருக்கும் என்றும் நாங்கள் கருதுகிறோம். 

அதன்படி, "சாதி இல்லை, மதம் இல்லை" என்ற சான்றிதழ் வழங்கக் கோரும் விண்ணப்பங்களை நேர்மறையாக ஏற்றுக்கொள்ள வருவாய் அதிகாரிகளுக்கு ஒரு குறிப்பிட்ட அறிவுறுத்தலுடன், தேவையான அரசு உத்தரவுகளை பிறப்பிக்குமாறு தமிழ்நாடு அரசை நாங்கள் கேட்டுக்கொள்கிறோம். 

மேற்கண்ட விவாதங்களின் வெளிச்சத்தில், 22.01.2024 தேதியிட்ட W.P.No.1290 of 2024 இல் ரிட் நீதிமன்றம் பிறப்பித்த உத்தரவு ரத்து செய்யப்படுகிறது. இதன் விளைவாக, இதில் 1வது மற்றும் 2வது பிரதிவாதிகள் 25.09.2023 மற்றும் 15.12.2023 தேதியிட்ட மேல்முறையீட்டாளரின் பிரதிநிதித்துவங்களை உடனடியாக ஏற்றுக்கொண்டு, இந்தத் தீர்ப்பின் நகல் கிடைத்த நாளிலிருந்து குறைந்தபட்சம் ஒரு மாத காலத்திற்குள், மேல்முறையீட்டாளருக்கு "சாதி இல்லை, மதம் இல்லை" என்ற சான்றிதழை வழங்க வேண்டும் என்று ஒரு உத்தரவு பிறப்பிக்கப்படும். எனவே, ரிட் மேல்முறையீடு அனுமதிக்கப்படுகிறது. எந்த செலவும் இல்லை.

We are of the considered view that the claim of the appellant to have himself and his family members certified by the Government of not belonging to any caste or any religion is a laudable claim, which in the long run, would promote prohibition of caste based discrimination and also would be an eye opener for like minded citizens.

Accordingly, we call upon the Government of Tamil Nadu to pass necessary Government Orders, with a specific instruction to the Revenue Authorities to positively entertain applications seeking for grant of certificate of “No Caste No Religion”.

 In the light of the above discussions, the order passed by the Writ Court in W.P.No.1290 of 2024 dated 22.01.2024 is set aside. Consequently, there shall be a direction to the 1st and 2nd respondents herein to forthwith entertain the appellant's representations dated 25.09.2023 and 15.12.2023 and issue a “No Caste No Religion” certificate to the appellant herein, atleast within a period of one month from the date of receipt of a copy of this judgment. The Writ Appeal stands thus allowed. No costs.
