The Government of Tamil Nadu has decided to file a Review Petition before the Hon'ble Supreme Court of India against the judgment delivered on 01 September 2025 in Anjuman Ishaat-e-Talim Trust vs State of Maharashtra &Others.
In this judgment, the Hon'ble Court directed that all in-service teachers who do not possess the Teacher Eligibility Test (TET) qualification must acquire it within two years. If they fail to do so, they would face compulsory retirement with terminal benefits. Teachers with less than five years of service remaining have been allowed to continue till retirement, but without eligibility for promotion.
While the Government of Tamil Nadu fully supports the principle that teacher quality must be continuously improved and that TET should remain a compulsory requirement for future appointments, the retrospective application of this requirement to teachers who were already in service has created grave concern. Thousands of teachers were recruited in full compliance with the laws,rules, and procedures in force at the time of their appointment. To now impose a new qualification on them decades later, and compulsorily retire them, if they do not qualify is neither fair nor sustainable.
If implemented in its present form, the ruling will cause mass compulsory retirements, leaving schools across Tamil Nadu with crippling teacher shortages. It will be practically impossible to recruit or train an equivalent number of TET-qualified teachers in the short timeframe provided. Such a situation will inevitably affect the education of lakhs of students, disrupt classroom teaching, and create instability in the school system.
The Review Petition is being filed on the following key grounds:
. The Right of Children to Free and Compulsory Education Act, 2009(RTE Act) under Section 23 regulates minimum qualifications only for new appointments. It does not authorise compulsory retirement of teachers already in service.
The NCTE Notification dated 23 August 2010 - which first introduced TET - clearly stated that its provisions would not apply to teachers already appointed prior to that date.
Retrospective application of TET unsettles vested rights of lawfully appointed teachers, causes disproportionate hardship, and threatens the stability of the education system.
The Government of Tamil Nadu is committed to ensuring both quality in education and justice for teachers. The Review Petition seeks to strike this balance - by protecting the livelihoods and service rights of in-service teachers, while maintaining strict compliance with TET for all future appointments.
The Hon'ble Supreme Court will now be approached to reconsider its judgment, and the Government will strongly present the case that this issue involves not only legal and constitutional principles but also the future of students across the State.
The Government of Tamil Nadu reassures the teaching community that it stands firmly with them. The State will pursue this matter vigorously and take it forward to its logical and fair conclusion, so that the interests of teachers are protected, and the right of every child to receive quality education remains secure.
